These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”) and DevIt International (“we”, “us”, or “our”), the operator of DevIt Learn, accessible at devitlearn.com (“Platform”). By registering, purchasing a course, or accessing the Platform, you agree to be bound by these Terms.
These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020.
Eligibility
You may use the Platform if:
- You are 18 years of age or older; or
- You are between 13 and 17 years of age and have obtained verifiable consent from a parent or legal guardian who agrees to these Terms on your behalf
- You are not barred from entering into contracts under applicable law
By using the Platform, you represent and warrant that you meet the above eligibility requirements.
Account Registration
2.1 Account Creation
To access courses and features on the Platform, you must create an account. You agree to:
- Provide accurate, complete, and up-to-date information during registration
- Maintain the confidentiality of your login credentials
- Notify us immediately at legal@devitlearn.com if you suspect unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
2.2 One Account Per User
Each account is for individual use only. You may not share your account credentials with others or allow third parties to access the Platform using your account.
2.3 Account Suspension
We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms or that your account poses a security or legal risk.
Courses and Content
3.1 Course Access
Upon purchase of a course, you are granted a limited, non-exclusive, non-transferable licence to access and view the course content for personal, non-commercial educational purposes. Unless otherwise stated, course access is:
- Lifetime access for self-paced courses
- Time-limited for cohort-based or subscription courses, as specified at the time of purchase
3.2 Intellectual Property
All course content on the Platform - including videos, text, graphics, assessments, code samples, and materials - is the intellectual property of DevIt International or its licensed content creators and is protected under Indian copyright law (Copyright Act, 1957) and international IP treaties.
You may not:
- Download, copy, reproduce, or redistribute course content without our written permission
- Share your account access or course materials with third parties
- Use course content for commercial purposes, including resale or sub-licensing
- Create derivative works from course content without express written consent
3.3 Certificates
Certificates of completion are issued upon satisfying the requirements of a course (e.g. completing all modules and assessments). Certificates are for personal use and professional portfolio purposes. We reserve the right to revoke a certificate if we determine it was obtained in violation of these Terms.
3.4 User-Generated Content
If the Platform allows you to post content (e.g. discussion forum posts, assignment submissions), you grant us a non-exclusive, royalty-free licence to use, display, and distribute that content on the Platform for educational purposes. You represent that your content does not infringe any third-party rights and is not unlawful or offensive.
Payments and Pricing
4.1 Pricing
All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes (GST) unless otherwise stated. We reserve the right to update pricing at any time. Changes will not affect orders already placed and confirmed.
4.2 Payment Processing
Payments are processed through third-party payment gateways. By making a payment, you agree to the terms of the relevant payment processor. We are not liable for errors, failures, or delays caused by third-party payment infrastructure.
4.3 GST Invoicing
As required under the Goods and Services Tax (GST) regime in India, a GST-compliant invoice will be issued for each purchase. If you require a Business-to-Business (B2B) invoice with your GST Identification Number (GSTIN), please provide your GSTIN at the time of purchase.
4.4 Refund Policy
We want you to be satisfied with your purchase. Our refund policy is as follows:
- Refund requests submitted within 7 days of purchase will be considered, provided that less than 20% of the course content has been accessed
- No refunds will be issued after 7 days of purchase or once a certificate of completion has been issued
- Refunds are not available for subscription plans after the billing period has commenced
- To request a refund, email legal@devitlearn.com with your order details. Approved refunds will be processed within 7–10 business days to the original payment method
This refund policy is consistent with our obligations under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.
Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorised access to any portion of the Platform or its infrastructure
- Upload or transmit viruses, malware, or any harmful code
- Harass, threaten, or defame other users on any community or discussion feature
- Impersonate any person or entity
- Use automated tools, bots, or scripts to scrape or extract course content
- Circumvent any technical protection measures or digital rights management
- Engage in academic dishonesty, including sharing quiz answers or submitting others’ work as your own
Disclaimers
6.1 Educational Purpose
Courses on the Platform are designed for educational and skill development purposes. We do not guarantee employment, career advancement, or specific outcomes as a result of completing any course. Any statistics, projections, or testimonials presented are illustrative and not guaranteed results.
6.2 Platform Availability
We strive to maintain the Platform with minimal downtime, but we do not guarantee uninterrupted availability. We may suspend or restrict access for maintenance, security, or operational reasons.
6.3 Third-Party Content
Some courses may reference or link to third-party tools, libraries, or resources. We are not responsible for the availability, accuracy, or terms of any third-party content.
Limitation of Liability
To the maximum extent permitted under Indian law, DevIt International’s total aggregate liability to you for any claims arising out of or related to the Platform shall not exceed the amount paid by you for the specific course or service giving rise to the claim in the three (3) months preceding the claim.
We shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of data, loss of income, or loss of opportunity.
Indemnification
You agree to indemnify and hold harmless DevIt International, its directors, employees, and agents from any claims, liabilities, losses, damages, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; or (c) your infringement of any third-party intellectual property or other rights.
Grievance Redressal
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the IT Act, 2000, we have designated a Grievance Officer:
If your complaint is not resolved to your satisfaction, you may escalate the matter to the relevant consumer forum under the Consumer Protection Act, 2019.
Privacy
Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.
Modifications to the Platform and Terms
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time. We may also update these Terms periodically. Material changes will be communicated to registered users via email or an in-Platform notice at least 15 days in advance. Continued use after the effective date constitutes acceptance.
Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably through direct negotiation.
If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts located in India (based on our registered office location).
Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force.
